1. GENERAL This website is NZ owned by Montrose Gardens Limited trading as Delicious. “Customer” means the person who purchases produce “Delicious Produce” means www.deliciousproduce.co.nz “GST” means Goods & Services Tax chargeable in accordance with the Goods & Services Tax Act 1985 “Product” or “Produce” means produce for sale on the deliciousproduce website By using Delicious Produce you agree that you have read, understood and accepted these terms and conditions. All fruit and other products supplied by Delicious Produce will be in accordance with these terms and conditions and Delicious Produce has the right to change these terms and conditions from time to time. Delicious Produce has the discretion to decline any order placed or cancel any order for any reason. Customers are liable for every order made using their contact details. Delicious Produce takes steps to ensure the information provided on its website is correct, however, there is no warranty in this regard and Delicious Produce will not be liable for any error or omission. All photos show a representation of the appearance of the actual produce, but there is likely to be variations within a variety. 2. PRICE The customer will pay Delicious Produce for the fruit ordered at the price displayed on the website at the time the order is submitted together with all freight costs, unless otherwise advised. Freight costs are determined by location and total order value. For some rural areas there will be an additional cost charged per box of produce ordered. In the event the customer has selected an incorrect shipping option, Delicious Produce reserves the right to refuse or cancel the order, or to charge for any additional freight costs. The customer will be notified if there is additional delivery charges for their order. The prices of produce and freight costs are in New Zealand currency and are inclusive of GST. If Delicious Produce is unable to supply the product ordered, Delicious Produce will advise the customer when it will next be available or that the current season is over and give an estimated date of when it will likely become available again. 3. PRODUCT QUALITY The customer acknowledges Delicious Produce is selling perishable goods. Delicious Produce will, at its discretion, replace any damaged fruit or provide a refund provided the customer lets Delicious Produce know within 48 hours of receiving the damaged fruit. If requested by Delicious Produce, the customer may need to provide a photo of damaged fruit before any refund or replacement. Delicious Produce will not be liable for damage to fruit as a result of it being incorrectly stored or handled after delivery. 4. PAYMENT Customers must pay for the fruit purchased before their order will be dispatched. The customer is liable for all costs associated with debt collection. 5. DELIVERY Delicious Produce reserves the right to withhold delivery of any product for any reason whatsoever. Deliveries will be made to the address and location the customer has identified on the order and once left at the specified address the fruit will be deemed to be delivered. The customer will ensure Delicious Produce or its freight company is able to deliver where instructed by the customer. *Maximum charge of $20 freight per order anywhere else in NZ is quoted on a case-by-case basis and subject to customer's approval. Payment received will be considered acceptance. 6. LIABILITY AND INDEMNITY, PRODUCT LIABILITY & LIABILITY DELICIOUS PRODUCE Delicious Produce is not liable for any loss, damage or injury arising directly or indirectly from any produce. Delicious Produce is not liable for any consequential injury or loss of any kind arising from the customer’s use of Delicious Produce or the delivery or failure to deliver fruit. 7. INDEMNITY The customer agrees to indemnify deliciousproduce against all liabilities, losses, claims and expenses arising directly or indirectly out of the 8. GUARANTEE If the customer is not completely satisfied with the quality of deliciousproduce product after delivery, deliciousproduce will provide a replacement or a refund. 9. REFUNDS Delicious Produce does not refund you if you change your mind. Please see above for information on the replacement of damaged goods.
